5. User Accounts and Registration

To register for an account on iart.top, you must provide accurate and complete information, including a valid email address. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer and devices to prevent unauthorized access to your account. You agree to accept responsibility for all activities that occur under your account or password.

You agree to not create more than one account for personal or business use unless authorized by us to do so and you will not share or provide access to your account to more than one user at a time being the user who created the account.

You agree that by registering an account you authorize us to use your contact information regarding any notifications for marketting and account updates. You can unsubscribe and resubscribe from email and sms notifications from the dashboard account contact information section at anytime.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion at anytime.

6. Payment and Refunds

By using our paid services or products, you agree to pay all applicable fees, taxes, and charges. We may change our fees at any time by posting a notice on our website. If you are not satisfied with our services, you may request a refund within 30 days of your purchase. We reserve the right to deny refund requests if we suspect abuse of our refund policy or violation of our Terms of Use.

7. User-Generated Content

You may contribute content, such as images or comments, to our website or services. By contributing content, you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and distribute your content in any media and for any purpose, including for marketing and promotion of our website and services. Please note that some information, such as your payment history, may be retained for our records and for legal requirements. We may also retain certain information to prevent fraud or abuse, to enforce our Terms of Use, or to comply with legal obligations. We will handle your information in accordance with our Privacy Policy.

11. Prohibited Activities

You agree not to engage in any activity that interferes with or disrupts the Site or its servers or networks, or that could damage, disable, overburden, or impair the Site or its services. You also agree not to:

• Attempt to gain unauthorized access to the Site, user accounts, or computer systems or networks connected to the Site.
• Attempt to introduce viruses, worms, or other harmful code to the Site or its services.
• Send unsolicited or unauthorized advertising, promotional materials, or spam to other users of the Site.

12. Termination and Suspension

We reserve the right to terminate or suspend your account or access to our website and services at any time, with or without cause, including for violation of our Terms of Use or applicable laws and regulations. We may also remove or modify any content that you have contributed to our website or services.

13. Indemnification

You agree to indemnify and hold iart.top, its affiliates, and their respective officers, directors, employees, and agents harmless from any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of the Site or your violation of these Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the province of Ontario and the federal laws of Canada applicable therein, without giving effect to any principles of conflicts of law. Any legal action or proceeding arising under these Terms or related to the Site shall be brought exclusively in the courts located in the province of Ontario, and you agree to submit to the personal jurisdiction of such courts.

15. Custom Requests

These requests will be delivered within 24 hours after a request has been reviewed. We will aim to review each custom request within 72 hours from the date of submission and provide a completion date within 72 hours once reviewed and started. The 72 hours might not include holidays and special events which could interupt or increase the 72 hour response time. In the event that a delay or cancelation has occured, this will be reflected on the custom request status. Once a request is completed the status will be reflected as needed along with the custom requested content. Requests are not considered under review unless the user has made a successful submission from the dashboard and recieved a successful message upon submitting the request. If a payment is required for a custom request, the payment must be fully completed before a request can be submitted for review. If payment has not been made within 24 hours or addtiional payments are required based on the request content, the status will be reflected on the request within the dashboard.

16. Service Level Agreement (SLA) Statement

We are committed to providing uninterrupted access to our platform and service to the best of our abilities. We strive for 99% availability of the platform, measured over a given time period, while recognizing that unforeseen interruptions may occur. We aim to respond to critical issues within hours. In the event that we fail to meet the specified availability commitment, we will evaluate each case individually and consider providing appropriate service credits for use on the platform. Downtime Exclusions:

• Planned maintenance activities for which we will provide advance notice to minimize disruption
• Unforeseen network disruptions that are beyond our control, such as internet outages or third-party service provider issues.
• Downtime incurred during the deployment of essential upgrades, updates, or enhancements to improve the service.
• Any unavoidable technological changes required for the continued operation and security of the platform.
• Customers are encouraged to report any service disruptions or incidents promptly to our support team via email.
• This SLA statement is intended to outline our commitment to service availability and transparency regarding downtime events while acknowledging that certain factors may occasionally impact our ability to maintain uninterrupted service.

17. Changes to these Terms

iart .top reserves the right, at its sole discretion, to modify or replace these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms.
